Terms of Service

The rules that govern your use of BizPOS — plainly written, so you know exactly where you stand.

01Agreement to These Terms

These Terms of Service (“Terms”) are a legal agreement between you (either as an individual or on behalf of the business you represent) and BizPOS Technologies (“BizPOS”, “we”, “us”).

They cover your use of the BizPOS platform — this website, the admin portal, the cashier and tablet applications, any customer-facing website we host for you, and all related services (together, the “Service”).

By creating an account, starting a free trial, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

02Eligibility

To use the Service you must:

  • Be at least 18 years old.
  • Have the legal authority to enter into this agreement on behalf of your business.
  • Operate a lawful business and provide accurate registration information.
  • Not be barred from receiving the Service under any applicable law or sanctions list.

If you accept these Terms on behalf of a company, “you” means that company, and you confirm you are authorised to bind it.

03Your Account and Security

You are responsible for everything that happens under your account, including the actions of any staff member you invite. Specifically, you agree to:

  • Provide accurate, current information at signup and keep it up to date.
  • Keep passwords and PINs confidential and not share a single login between multiple people.
  • Assign each staff member their own login and only the permissions their role requires.
  • Remove access promptly when a staff member leaves.
  • Notify us immediately at info@bizpos.pk if you suspect unauthorised access.

We are not liable for any loss arising from your failure to keep your credentials secure.

04Free Trial

We offer a 14-day free trial so you can evaluate the Service. No credit card is required to start, and you can stop at any time.

  • The trial gives access to the features of the plan it is based on, and may include usage limits.
  • One trial per business. We may refuse repeat or duplicate trials.
  • When the trial ends, your account moves to a paid plan only if you choose to subscribe. If you do not subscribe, access is suspended and your data is retained for a limited period (see Data Retention) before deletion.
  • We may modify or withdraw the trial offer at any time.

05Subscriptions, Fees and Payment

Paid plans are billed in advance on a recurring basis (monthly or annually, as selected). All prices are quoted in Pakistani Rupees (PKR) unless stated otherwise.

  • Renewal— subscriptions renew automatically for the same period until cancelled.
  • Taxes— fees are exclusive of any applicable sales tax, GST, or withholding tax, which you are responsible for.
  • Late or failed payment— if payment is not received when due, we may suspend access to the Service after giving you notice. Your data is not deleted during a short suspension.
  • Upgrades and downgrades— upgrades take effect immediately and are charged on a pro-rata basis. Downgrades take effect at the start of the next billing period and may reduce the features available to you.
  • Price changes — we may change our prices with at least 30 days notice. Changes apply from your next renewal, and you may cancel before then if you do not accept them.

06Cancellation and Refunds

You may cancel your subscription at any time by contacting us. Cancellation takes effect at the end of the current billing period, and you keep access until then.

  • Fees already paid are non-refundable except where required by law.
  • We do not provide partial refunds for unused time in a billing period.
  • If we terminate your account for a reason other than your breach of these Terms, we will refund any prepaid fees covering the period after termination.
  • Export your data before cancelling — we can provide it in a machine-readable format on request.

07Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose, or to record or facilitate fraudulent transactions.
  • Resell, sublicense, rent, or white-label the Service without our written permission.
  • Reverse engineer, decompile, or attempt to extract the source code of any part of the Service, except where such a restriction is prohibited by law.
  • Circumvent usage limits, plan restrictions, licensing, or security controls.
  • Upload malware, or attempt to gain unauthorised access to our systems or another customer’s data.
  • Overload, probe, or disrupt our infrastructure, or run automated scraping against it.
  • Use the messaging features to send spam, or to contact people who have not agreed to hear from your business.
  • Upload content that infringes someone else’s intellectual property or privacy rights.

We may investigate suspected violations and suspend access while we do.

08Your Data and Content

You own your data.All business data you enter into the Service — your menu, products, orders, customers, staff records, and reports — remains yours.

You grant us a limited licence to host, store, process, transmit, back up, and display that data solely to operate and support the Service for you. We do not sell it and we do not use it for any purpose other than providing the Service, except in anonymised, aggregated form that cannot identify you.

You are responsible for the accuracy and legality of the data you upload, and for having the right to collect and store any personal information about your customers and staff. See our Privacy Policy for how that data is handled.

09Our Intellectual Property

The Service, including its software, source code, design, user interface, documentation, and the BizPOS name and logo, is owned by BizPOS Technologies and protected by intellectual property law.

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own business operations. No other rights are granted.

If you send us feedback or feature suggestions, we may use them freely to improve the Service without obligation to you.

10Availability, Offline Mode and Support

We aim for high availability and work to keep the Service running reliably, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable during scheduled maintenance, emergency fixes, or events outside our control.

  • We will give reasonable advance notice of planned maintenance where we can, and schedule it outside peak trading hours where practical.
  • Offline mode lets the cashier and tablet applications keep taking orders without internet. Data captured offline syncs when the connection returns. You are responsible for keeping devices powered, secure, and connected regularly enough to sync.
  • Support is provided by email, phone, and WhatsApp during business hours. Response times may vary by plan.
  • We may add, change, or remove features over time. We will not materially reduce core functionality of a paid plan without notice.

11Third-Party Services and Hardware

The Service may work alongside third-party products — payment terminals, printers, biometric devices, messaging gateways, delivery platforms, and cloud providers. Those are supplied under their own terms and we are not responsible for their availability, accuracy, pricing, or conduct.

Hardware you buy from us or a reseller is covered by the manufacturer’s warranty. Compatibility guidance we provide is offered in good faith but is not a guarantee.

12Suspension and Termination

We may suspend or terminate your access to the Service if:

  • You breach these Terms and, where the breach can be fixed, fail to fix it within 7 days of notice.
  • Payment is overdue after we have notified you.
  • Your use poses a security, legal, or operational risk to us or to other customers.
  • We are required to do so by law.

You may terminate at any time by cancelling your subscription. On termination, your licence to use the Service ends immediately. We will retain your data for the period described in our Privacy Policy so you can request an export, after which it is deleted.

13Disclaimer of Warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet every requirement of your business, that it will be uninterrupted or error-free, or that all defects will be corrected.

Reports, tax calculations, and financial figures produced by the Service are tools to assist you. They do not constitute accounting, tax, or legal advice. You remain responsible for verifying your records and for your own regulatory and tax compliance.

14Limitation of Liability

To the maximum extent permitted by law, BizPOS is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, goodwill, business opportunity, or data, however caused.

Our total aggregate liability arising out of or relating to the Service, whether in contract, tort, or otherwise, is limited to the amount you actually paid us for the Service in the three (3) months immediately before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by negligence.

15Indemnity

You agree to indemnify and hold BizPOS, its directors, employees, and contractors harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your data, your breach of these Terms, or your violation of any law or third-party right.

16Governing Law and Disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules.

If a dispute arises, we ask that you contact us first so we can try to resolve it informally — most issues are settled this way. If we cannot resolve it within 30 days, the dispute will be subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan.

17General Terms

  • Entire agreement— these Terms and the Privacy Policy are the whole agreement between us regarding the Service and supersede any earlier understanding.
  • Severability— if any provision is found unenforceable, the rest remains in full effect.
  • No waiver— our failure to enforce a right is not a waiver of that right.
  • Assignment— you may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, or sale of assets.
  • Force majeure— neither party is liable for failures caused by events beyond reasonable control, including power or internet outages, natural disasters, or government action.

18Changes to These Terms

We may update these Terms as the Service develops or as the law requires. When we do, we will update the “Last updated” date at the top of this page. For material changes we will give you notice by email or an in-app message before they take effect.

Continuing to use the Service after the changes take effect means you accept the revised Terms. If you do not accept them, you may cancel your subscription.
